Las investigaciones que Carlos Alchourrón desarrolló en la Filosofía del Derecho se vincularon, desde inicios de la década de 1980, con problemáticas críticas de la Inteligencia Artificial. Su contribución a la construcción de una lógica de las normas se conectó rápidamente con la deducción automática y los Sistemas Expertos Jurídicos. Su preocupación por la cuestión de los conflictos de obligaciones que pueden plantearse en un sistema normativo cuando el juez se enfrenta a la necesidad de emitir un veredicto considerando ciertos (...) hechos, se vinculó, en sus trabajos, con la noción más general de "condicionales derrotables" y con la formalización del Razonamiento No Monótono. Pero su contribución de mayor impacto fue aquella derivada de la búsqueda de una solución al problema de los resultados múltiples que surgen de la derogación de una norma en un sistema jurídico, problema que puede ser visto, en un contexto epistémico, como el de la contracción de un conjunto de creencias. Su enfoque constructivo, que desarrolló con David Makinson, convergió con el axiomático elaborado por Peter Gärdenfors, dando lugar al surgimiento de la teoría de los Cambios Racionales de Creencias, más conocida como AGM, teoría que fue adoptada en IA como un modelo standard para la especificación de las actualizaciones de Bases de Conocimiento, operaciones que, habitualmente, involucran la introducción de una nueva creencia que puede ser inconsistente con las anteriores. ¿Por qué AGM adquirió rápidamente carta de ciudadanía en IA, al punto de que su influencia, medida según la cantidad de menciones bibliográficas del artículo fundacional de 1985, se ha duplicado en la última década? Mostraremos en este trabajo que la teoría apareció en un momento de crisis de la IA y que el alto nivel de abstracción del modelo de AGM era lo que muchos investigadores de la disciplina estaban buscando. El presente artículo, luego de describir la génesis de AGM, realiza un análisis histórico de las circunstancias en las cuales la teoría se introdujo en la IA y una evaluación cuantitativa y cualitativa de su impacto en dicha disciplina. The main lines of research that Carlos Alchourrón developed in the Philosophy of Law, were connected, from the beginnings of the 80' s, to some critical problems in the Artificial Intelligence. His contributions to the construction of a logic of norms were rapidly linked to automatic deduction and the Legal Expert Systems. His concerns for the conflict of obligations that could arise in a normative system when a judge has to issue a ruling taking some particular facts into account were associated in his work with the more general notion of "defeasible conditionals" and with the formalization of Non Monotonic Reasoning. But his most relevant contribution was the one derived from the search of a solution to the problem of multiple outcomes resulting from the derogation of a norm in a legal corpus, which may be considered -within an epistemic framework- analogous to the contraction of a set of beliefs. The constructive approach he worked out with David Makinson converged with Peter Gärdenfors' axiomatic, giving rise to the formulation of the theory of Rational Changes of Belief, which was adopted in AI as a model for the specification of the updates of Knowledge Bases as it usually involves a new belief that may be inconsistent with the old ones. La obra de Antonio Machado muestra una conocida amplitud temática que se manifiesta, además de en su poética, en sus aportaciones a la filosofía. El presente artículo pretende acercarse a su figura desde la conjunción entre la poética y la filosofía en base a un concepto fundamental en su obra: la alteridad. Como consecuencia de la quiebra de la razón moderna, el solipsismo de corte cartesiano quedó en suspenso. Es en este momento en el que tanto en Europa como en (...) la España de finales del siglo XIX surge una tendencia hacia la alteridad o reconocimiento del otro, tal y como veremos en la obra de Machado y en personajes esenciales de su producción como Juan de Mairena así como, también, en otros autores de la generación del 98. Esta comunicación busca rastrear de la mano de M. Abensour, dos posturas que tienen entre sí diferencias: el paradigma de lo político en Hannah Arendt y, el paradigma de la dominación como forma de lo político, planteado por Adorno y Horkheimer (E.de.F). La importancia está en comprender las diferencias y las implicaciones de cada postura respecto de la otra, en términos del objetivo final: la concepción de lo político desde una postura filosófica crítica.

The relationship between descriptive representation and substantive representation is an issue that has been widely discussed by women’s studies scholars. In general, it is assumed that there exists a positive relationship between the two, but the literature and empirical analysis show that substantive representation also depends on the action of other critical actors, such as gender agencies and the women’s social movement. Comparative research has shown the existence of a common pattern in post-industrial democracies: the development of women-friendly policies depends (...) on the existence of coalitions between these critical actors. However, the analysis usually focuses on the national or regional level, and there is very little analysis at the local level, despite this being a political arena in which these processes can be developed. The aim of this article is to analyse the effect of coalitions of critical actors on the responsiveness to the demands of women’s groups in the case of Spanish municipalities using a representative survey. The objective, therefore, is to apply advances in the women’s substantive representation literature to the local level in Spain. Main results show that responsiveness is higher in municipalities where women’s coalitions exist. (shrink)

Charles Taylor es comúnmente identificado como uno de los padres fundadores del comunitarismo teórico, pero tal identificación no da cuenta de la amplitud del pensamiento del filósofo canadiense. A través de este trabajo de investigación pretendemos articular la filosofía de Taylor partiendo del proyecto filosófico que explícitamente inicia en sus primeros trabajos, a saber, la configuración de una antropología filosófica, a través de la cual abordaremos los grandes temas que han ocupado su vida -ética, política y religión- en la puesta (...) en marcha de una filosofía con intenciones puramente prácticas.Charles Taylor is commonly identified as one of the founding fathers of theoretical communitarianism, but such identification does not realize the extent of his thinking. Through this research, we try to articulate the Taylor's philosophy from his philosophical project, that he explicitly started in his early work, namely, the configuration of a philosophical anthropology, through which we will address the major issues that have occupied his life - ethics, politics and religion- in the implementation of a philosophy with purely practical intentions. La fenomenología de la religión es una de las ciencias de las religiones surgida en el siglo XIX. Tras una época dorada, las dificultades epistemológicas y los debates suscitados en torno al estatuto del saber la abocaron a una profunda crisis interna. En la actualidad, existen dos formas de entender la fenomenología de la religión: la primera, como historia comparada de las religiones, centrada en la descripción y clasificación de los fenómenos religiosos; la segunda, como fenomenología hermenéutica, centrada en la (...) comprensión del fenómeno religioso. Ambas corrientes constituyen dos visiones divergentes de la fenomenología de la religión. Sin embargo, podrían concebirse como dos fases fenomenológicas convergentes que apuntan a la consolidación de una antropología filosófica de la religión. En este artículo, analizamos el objetivo, los principales representantes, las dificultades epistemológicas y los logros de cada una de estas for-mas de comprender la fenomenología de la religión y su posible conjugación en la configuración de una filosofía fenomenológica de la religión.The phenomenology of religion is one of the sciences of religions emerged in the 19th century. After a golden age, the epistemological difficulties, and the debates about the status of knowledge led to a deep internal crisis. At present, there are two ways of understanding the phenomenology of religion: the first, as a com-parative history of religions, focused on description and classification of religious phenomena; the second, as a hermeneutical phenomenology, focused on the understanding of religious phenomena. Both currents constitute two divergent views of phenomenology of religion. However, they can be conceived as two convergent phenomenological phases that point to the consoli-dation of a philosophical anthropology of religion. In this paper, we analyze the goal, main representatives, epistemological difficulties and achievements of each of these ways of understanding the phenomenology of religion and its possible conjugation in the configuration of a phenomenological philosophy of religion. Fundamental records of Post-Husserlian Philosophy are highlighted by Sein und Zeit, Lʼêtre et le néant and the Phénoménologie de la perception, the work by Merleau-Ponty that deals with the problem of intersubjectvity, starting from a very particular concept of the body understood as «a work of art». However, the reasoning developed in his work of 1945 is about the sociopolitical dimensions of present intersubjectivity. This article carries out the analysis of later works by Merleau-Ponty, in which he studies the relationship (...) between Perception and everyday life to continue with the consideration of the aesthetic and pictorial sphere in order to develop a theory of Vision that has to be understood as a complement to the theory of Perception. This theory would be the ground to transcend the contingency and locate the relationship present-past as the final step of the theory of Intersubjectivity. (shrink)

La generación del 98 surgió como consecuencia de una compleja situación económica, social, cultural y política sufrida por nuestro país. La derrota en la Guerra de Cuba y las consecuentes pérdidas coloniales fueron el detonante más inmediato que culmina-ron en un ánimo enrarecido y con aires decadentes. Fruto de este angosto clima surgió una nueva visión de la filosofía y la novela, esto es, una perspectiva hermenéutica diferente de la realidad del momento. En este sentido, haremos mención a cuatro de (...) las obras principales que contribuyeron a dicha construcción teórica, al tiempo que desgranaremos su vertiente filosófica y la incidencia de las mismas en el conocido como problema de España. Pero, ¿qué ocurre con la visión femenina? ¿Cómo fueron las representaciones de las mujeres en estas obras? ¿qué tenían que decir las mujeres de esta generación? Para repensar las humanidades en la actualidad, es pertinente y esencial revisar los cimientos más inmediatos de nuestra filosofía y nuestra literatura, a la par que se torna crucial revisar la perspectiva femenina pues, solo de este modo, podremos tener una visión integradora de la importancia y la actualidad de las humanidades. The objective of this research is to develop accurate forecasting models for chlorophyll-α concentrations at various depths in El Mar Menor, Spain. Chlorophyll-α plays a crucial role in assessing eutrophication in this vulnerable ecosystem. To achieve this objective, various deep learning forecasting techniques, including long short-term memory, bidirectional long short-term memory and gated recurrent uni networks, were utilized. The models were designed to forecast the chlorophyll-α levels with a 2-week prediction horizon. To enhance the models’ accuracy, a sliding window method (...) combined with a blocked cross-validation procedure for time series was also applied to these techniques. Two input strategies were also tested in this approach: using only chlorophyll-α time series and incorporating exogenous variables. The proposed approach significantly improved the accuracy of the predictive models, no matter the forecasting technique employed. Results were remarkable, with |$\overline{\sigma}$| values reaching approximately 0.90 for the 0.5-m depth level and 0.80 for deeper levels. The proposed forecasting models and methodologies have great potential for predicting eutrophication episodes and acting as decision-making tools for environmental agencies. Accurate prediction of eutrophication episodes through these models could allow for proactive measures to be implemented, resulting in improved environmental management and the preservation of the ecosystem. Gracias a la documentación conservada en la Real Academia de la Historia y a una cuidada revisión bibliográfica, se aportan nuevos datos para el conocimiento del descubrimiento y primeros estudios del epitafio del monarca aftasí, Abd Allah al-Mansur I de Badajoz.

Resumen. El siguiente artículo muestra el estado actual de la Responsabilidad Empresarial enMéxico y su efecto en el Riesgo medido a través del Costo de Capital. Para ello, revisamos lasprincipales teorías que muestran que el uso de prácticas sociales en Estados Unidos provocandisminución del riesgo y por ende del Costo de Capital, Aras y Crowther, Richardson yWelker y Diamond y Verrechia. Con el fin de contrastar que las empresas SocialmenteResponsables tienen costos de capital menores consideramos como variable de desempeño social (...) eldistintivo que otorga el Centro Mexicano de Filantropía y por otra parte para calcular elriesgo consideramos el costo de capital a través de la metodología del Capital Asset Price Modelo. Encontramos que las empresas que son socialmente responsables tienen costos de capitalsuperiores que las que no son responsables y que el rendimiento de acciones es superior en lasempresas no responsables, por lo que el diferencial de riesgo vs rendimiento es superior en lasempresas no socialmente responsables. The following article shows the current status of the corporate responsibility inMexico and their effect on risk measured by the cost of capital. To do this, we review the maintheories that show that social practices in the United States leads to decrease risk and hence the costof Capital Aras and Crowther, Richardson and Welker and Diamond y Verrechia. In order to contrast that socially responsible companies have lower capital costs we considersocial performance variable the distinction conferred by the Mexican Center for Philanthropy and the cost of capital it estimate on the methodology of the Capital Asset Price model. We find that companies that are socially responsible have capital costs higher than thosethat are not responsible. Automated legal reasoning and its application in smart contracts and automated decisions are increasingly attracting interest. In this context, ethical and legal concerns make it necessary for automated reasoners to justify in human-understandable terms the advice given. Logic Programming, specially Answer Set Programming, has a rich semantics and has been used to very concisely express complex knowledge. However, modelling discretionality to act and other vague concepts such as ambiguity cannot be expressed in top-down execution models based on Prolog, and in (...) bottom-up execution models based on ASP the justifications are incomplete and/or not scalable. We propose to use s(CASP), a top-down execution model for predicate ASP, to model vague concepts following a set of patterns. We have implemented a framework, called s(LAW), to model, reason, and justify the applicable legislation and validate it by translating (and benchmarking) a representative use case, the criteria for the admission of students in the “Comunidad de Madrid”. Background: The first wave of the COVID-19 pandemic caused a shortage of qualified nurses in Spain. As a result, the government authorized the hiring of senior students. Objectives: To explore the ethical dilemmas and ethical conflicts experienced by final-year nursing students who worked during the first outbreak of the COVID-19 pandemic in Spain. Research design: A qualitative exploratory study was conducted using purposive sampling. Semi-structured interviews were carried out using a question guide. Interviews took place via a private video chat (...) room platform. A thematic, inductive analysis was performed of the information gathered. Participants and research context: Eighteen nursing students were recruited from two universities of Madrid, aged between 18 and 65 years old, enrolled in the fourth year of nursing studies and who were hired under a relief contract for health professionals during the pandemic. Ethical considerations: The present study was carried out in accordance with the Declaration of Helsinki, and the study was approved by the Local Ethics Committee of Universidad Rey Juan Carlos. Results: Three specific themes emerged: (a) coping with patient triage, (b) difficulties in providing end-of-life care, and (c) coping with patient death. Nursing students participated in the process of patient selection for resource allocation and ICU bed occupancy. They were shown how to care for patients who were not admitted to the ICU, in their last moments and were faced with the difficulties of applying end-of-life care. Finally, the nursing students were confronted with the death of their patients, in overwhelming numbers and under adverse conditions. Conclusions: These findings can help shed light on the ethical dilemmas and ethical conflicts faced by novice nursing students, incorporated into the workforce during the COVID-19 pandemic. Moreover, it was described that students may normalize the death due to the exhaustion and overwhelmed routine. (shrink)

Background No studies have been conducted in Mexico to ascertain what ethical problems doctors working at hospitals deal with. This article aims to describe the ethical conflicts most commonly identified by Mexican internists and the importance they attribute to each of these conflicts. Methods Voluntary survey to the members of the Internal Medicine Association of Mexico. Results Responses were submitted by 347 internists. Half of those face ethical conflicts almost always or frequently. The most commonplace and relevant conflicts are those (...) resulting from the clinical relationship (communication, confidentiality, informed consent, assessment of mental capacity, decisions involving incapacitated patients, and conflicts with family members), and secondly those problems related with the end of life (palliative care, withholding or withdrawing treatment, and “No CPR orders”). To resolve conflicts they seek support through protocols, Institutional Ethics Committees (IECs), and consultations with colleagues and, occasionally, with bioethics experts. Protocols and IECs are the tools most in demand among them. Conclusions 1) the most frequent and relevant conflicts are those caused by the clinical relationship, above all those due to doctor–patient communication, and secondly those due to problems which arise at the end of life; 2) though nearly all of them have doubts about how to resolve conflicts, the vast majority are satisfied with the way in which they do so; 3) to deal with conflicts, they seek support mainly in protocols, IECs, and consultation with colleagues; and 4) in order to resolve them better, what they most demand are protocols and IECs, but also bioethics consultants. Agreement technologies refer to a novel paradigm for the construction of distributed intelligent systems, where autonomous software agents negotiate to reach agreements on behalf of their human users. Smart Cities are a key application domain for agreement technologies. While several proofs of concept and prototypes exist, such systems are still far from ready for being deployed in the real-world. In this paper we focus on a novel method for managing elements of smart road infrastructures of the future, namely the case (...) of auction-based road intersections. We show that, even though the key technological elements for such methods are already available, there are multiple non-technical issues that need to be tackled before they can be applied in practice. For this purpose, we analyse legal and ethical implications of auction-based road intersections in the context of international regulations and from the standpoint of the Spanish legislation. From this exercise, we extract a set of required modifications, of both technical and legal nature, which need to be addressed so as to pave the way for the potential real-world deployment of such systems in a future that may not be too far away. As a result of recent corporate scandals, several rules have focused on the role played by Boards of Directors on the planning and monitoring of corporate codes of ethics. In theory, outside directors are in a better position than insiders to protect and further the interests of all stakeholders because of their experience and their sense of moral and legal obligations. Female directors also tend to be more sensitive to ethics according to several past studies which explain this affirmation by (...) early gender socialization, the fact that women are thought to place a greater emphasis on harmonious relations and the fact that men and women use different ethical frameworks in their judgments. The goal of this paper is to determine the influence of these characteristics of the Board in terms of promoting and hindering the creation of a code of ethics. Our findings show that a greater number of female directors does not necessarily lead to more ethical companies. Moreover, within Europe as a continent, board ownership leads to an entrenchment of upper-level management, generating a divergence between the ethical interests of owners and managers. In light of this situation, the presence of independent directors is necessary to reduce such conflicts. (shrink)

The Greek word mētis (μῆτις) traditionally refers to a particular form of wily intelligence associated with the arts of deception (dolos) and the knowledge of tricks (kerdē), subterfuges, and traps. Mētis evokes innovative and ground-breaking solutions, based on the capability to understand, anticipate, and possibly violate the others’ expectations. Most importantly, mētis presupposes practical wisdom, or prudence (phrόnesis), a dispositional quality that underpins all the virtues that deserve to be cultivated by sportspersons and that is pivotal to perfect sportspersons’ moral (...) character. Not only is prudence required to apply mētis profitably for winning a game, but it is also indispensable to perform consistently with the game’s norms—cognizant of sport values. This analysis of mētis is key to illuminate the embodied dimension of tactical and moral reasoning in contemporary sport practice. In this paper, we first argue that the strategic effectiveness of mētis proves that not only sensorimotor control but also higher forms of intelligence, like strategic reasoning, are embodied and inform skilful performance; second, we argue that relying on mētis is necessary not only to interpret the rules of the game in one’s own favor but also to respect the shared values that these rules uphold in the sport practice. ABSTRACT:Ethical research on consumption has focused mainly on the obligations, principles and values guiding consumers' actions and reasons for action. In doing so, it has concerned itself mostly with such bounded contexts as voluntary simplifiers, anti-consumption movements or so-called ‘ethical consumers,’ thereby fostering an artificial opposition between ethical and non-ethical consumption. This paper proposes virtue ethics as a more apt conceptual framework for the ethical analysis of consumption because it takes into account the developmental dynamic triggered by engagement in consumption (...) practices. We build on MacIntyre's goods-virtues-practices-institutions framework and Beabout's concept of a domain-relative practice and argue that when engaging in consumption activities, agents may pursue goods internal to practices, further their individual life narratives and contribute to the good of their communities, thus developing virtues that perfect themselves both as consumers and as ethical agents. El presente ensayo intenta repensar las ciencias humanas a partir de la idea de espíritu que manejan los pueblos de la Amazonía. Para ello, se dará cuenta del pensamiento crítico brasileño contemporáneo, que asume la alteridad y la crisis ambiental como ejes centrales de sus reflexiones, para luego articularlo a una idea de ciencias humanas que asuman como objeto no lo humano, sino lo viviente.

This paper offers a re-reading of the works of Umberto Eco, be they academic, journalistic or literary, with a pseudologic tone: his desire to investigate the mechanisms of lying, and their relation with fiction, falsification, error, secrecy, and conspiracy. The study will review some of his main academic texts in the fields of semiotics, rhetoric, and aesthetics, and will make some references to his recent novels and essay compilations, as well as offer an explanation of how the evolution of his (...) thoughts takes a pessimistic turn. The face of the lie, which initially was aesthetic consolation and consumerist delusion, and then a game of intelligence, a creative stimulus and an interpretive challenge, changes when serves the purpose of extortion, manipulation, and war. In short, it could be argued that Eco became increasingly disappointed by deceptions, and lost faith in fakes and forgeries. (shrink)

The topic of this paper is the conceptual possibility of being someone else. This thought occurs in the first person, and in principle it could be entertained by any subject of experience. The paper will focus on the examination of the content of such a thought: i.e., what exactly is meant by the possibility of being someone else? By way of comparing this thought with other possibilities (e.g., the possibility of being taller), it will be shown that the possibility of (...) being someone else lacks coherence, mainly because it goes against many reasonable and well-established beliefs held about ourselves and our identity. En este trabajo ofreceré argumentos para mantener que el entorno co-textual de una expresión configura su significado y también conforma su referente. Donde el referente es resultado de una actividad metalingüística cuya base se encuentra en las operaciones lingüísticas de condensación, síntesis y reificación, entre otras. Lo anterior implica que se puede mantener una teoría referencial sin la necesidad de asumir compromisos ontológicos tal como lo manifestaron Russell y especialmente W. V. Quine. Me valdré de la construcción nominal “la radiación (...) adaptativa” con el objetivo de responder a qué tipo de entidades se refiere esta expresión. Una respuesta parcial e incompleta a esta interrogante la encontramos en Quine por esta razón intentaré desarrollarla más recurriendo a la lingüística operacional y a la lingüística de texto. In this paper I will offer arguments to show that the co-textual environment of an expression configures its meaning and also conforms its referent. Where reference is a result of a metalinguistic activity which is based on linguistic operations of condensation, synthesis and reification, among others. The above implies that we can maintain a referential theory without the necessity to assume ontological commitments as they manifested especially Russell and WV Quine. I will use the nominal construction “la radiación adaptativa” in order to respond to what kind of entities is covered by this expression. A partial and incomplete answer to this question is found in Quine for this reason I will try to develop appealing to operational linguistics and textual linguistics. (shrink)
